I think when Atmel and Microchip sublicense VIDs and PIDs they have to register the sublicense with USB-IF and wait for approval. Although they may sublicense to Damien for his production I doubt they would condone other parties using the open source files to manufacture clones or derivatives. However it is not a published policy like Microchip, Atmel and FTDI.
